REPRODUCTION RIGHTS GRANTED

The Photographic Reproduction Rights, which are to be granted, are contingent upon receipt of payment in full, which is due the day of the booking. Any and all images produced may be incorporated in their entirety and/or in any part in the representational, promotional and/or portfolio presentations of Tamara Benavente Photography. All rights not specifically granted in writing, including copyright, remain the exclusive property of the photographer.

 

WAIVER AND INDEMNIFICATION

If Photographer cannot perform this agreement in whole or in part due to a cause beyond the control of the parties, changing of details that no longer fit with the photographers’ originally agreed terms or due to Photographer’s illness or injury, then Tamara Benavente Photography will return all fees to the client(s) but shall have no further liability with respect to this Agreement. This is the parties’ entire agreement on this matter, superseding all previous negotiations or agreements. Client and it’s agent’s, family members and assignees, if any, shall hold harmless Tamara Benavente Photography and Tamara Benavente from any and all claims for damages arising out of the performance of any of the services contemplated by this Agreement.

 

DEPOSITS AND RESERVED TIME

Upon signing this contract/agreeing to the terms and conditions, Tamara Benavente Photography will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all payments are non-refundable.

YOUR SESSION

A payment of $100 is due at the signing of this agreement.

It is understood that even with the signing of a contract and/or verbal agreement, no session is reserved without a monetary deposit.

 

TIME

Your session lasts 10 minutes. There's no option to extend the shoot beyond that. If you wish more time, you must pay for additional time slots.

 

DAY OF THE SESSION

You agree that you will be on time at the chosen location. If you are late, time will be taken from your session.

 

RECEIVING YOUR RETOUCHED PHOTOS

Please allow up to 14 days from the date of your session to receive your images.

 

COLORING AND RETOUCHING

Basic retouching includes exposure and color correction. Basic retouching does not include things like skin retouching, physically changing body shapes, fixing dresses, removing people or things from a photo, fixing clothes/makeup/etc. or adding things to photos. The client may choose to pay per hour for extra retouching.

 

By choosing Tamara Benavente Photography, you acknowledge the style and colors used and agree to allow the photographer to choose the colors based on personal preference.

 

UNEDITED PHOTOS/PHOTO POLICY

Client agrees that unedited photos will not be shared for any reason. Only your retouched photos will be released. If you’d like to purchase additional photos, you must buy each image separate from your package. All outtakes and unedited photos are the property of Tamara Benavente Photography and are not to be shared, distributed or posted under any circumstances.

 

OVERALL APPEARANCE AND PERSONAL ITEMS

It is the client's responsibility to make sure their clothes, makeup, hair and overall appearance are the way they want for the photos. The photographer is not responsible for any styling, wardrobe, hair problems or any other factors in the photography other than the photography of the client.

 

CLIENT’S COOPERATION

The Client understands and agrees that children will not be forced into doing something they're not comfortable doing. Therefore, the Photographer shall not be responsible for photographs not taken as a result of the children's failure to provide reasonable assistance or cooperation.

 

DIGITAL FILES AND DELIVERY

You'll receive a link to a digital gallery with around 10 watermarked images from your session. You'll be able to select which ones you'd like. All purchased files will be sent digitally through WeTransfer or similar free file sharing site, and will be made available for download. Any additional edited photos ordered are non-refundable, whether or not you decide to keep them.

 

REFUNDS

Your payment is non-refundable.

 

CLIENT’S USAGE

The Client is obtaining photographs for personal use only, and shall not sell said photographs. No commercial use is granted by the issuance of print or digital photos.

 

EXCLUSIVITY

It is understood and agreed that no other person will be allowed to photograph or take pictures while the Photographer is working.

 

PHOTO REORDERING AND TIME FRAME

To keep organized and conserve space, your photos may be deleted or unavailable 120 days after your session has taken place, and you waive any and all claims against Tamara Benavente Photography for the unavailability of such photos, even if you must replace them at your own cost. Therefore, it is recommended you safely store and back-up your images.

 

PICK UP AND FINALIZATION

You will be contacted and made aware when your photos are ready, but it is your responsibility to check your email for your finished photos. It is also your responsibility to download your photos in a timely manner.
